Regulations

These terms and conditions set out the rules for the purchase of event tickets and the purchase of online training courses through the website operated by the Seller at https://www.juliafalowska.com.pl.

The owner and administrator of the website – https://www.juliafalowska.com.pl is FP GROUP SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, based at: ul. Jagiellońska 22, 33-300 Nowy Sącz, NIP: 7343557131.

§ 1. Definitions

For the purposes of these Regulations, the following meanings of the following terms are adopted:

  1. Regulations – this document, available at https://juliafalowska.com.pl/regulamin
  2. Seller – FP GROUP SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, with its registered office at: ul. Jagiellońska 22, 33-300 Nowy Sącz, NIP: 7343557131.
  3. Buyer – a person using the opportunity to purchase a ticket to participate in an event, or an online course at https://www.juliafalowska.com.pl, who, after completing the formalities, has entered into an Agreement for the provision of digital content with FP GROUP SPÓŁKA Z OGRANICZONĄ ODPOWIEDZNOŚCI.
  4. Parties – Seller and Buyer.
  5. Platform https://juliafalowska.com.pl – a website, as well as a store where you can purchase a course, event tickets, and an electronic training platform where course content is made available to Buyers.
  6. Course – available via https://www.juliafalowska.com.pl digital content, in accordance with the Omnibus Directive, containing a set of materials in accordance with the given topic, plan and detailed description of the course.
  7. Offer – a collection of information about available events (events), course, including in particular: description of content, gross price, access period and other elements.
  8. Payment Operator – TPay.
  9. Purchase – means the conclusion of a contract for the delivery of digital content electronically, between the Buyer and the Seller.
  10. Price – the gross price of the ticket, expressed in PLN, placed next to the information about the event.
  11. “Cookies ” – small text files sent to the Buyer’s computer, which contain information necessary for the proper functioning of the Website in particular the authorization process.

§ 2. General provisions

  1. Through the Website, the Seller sells an admission ticket and courses – provides the Buyer with an electronic service that consists in enabling the Buyer to conclude a contract with the Seller for the delivery of digital content in the form of a Course.
  2. In order to purchase an online course through the Website, the following technical conditions must be met by the Buyer’s computer or other device:
    • Internet access,
    • The latest versions of browsers installed,
    • having an active e-mail address,
    • No active cookie and/or ad blocking software,
    • Javascript enabled,

In order to use the course, it is necessary for the computer or other device of the Buyer to meet the following technical conditions:

  • Internet access,
  • latest versions of browsers installed
  • No active cookie and/or ad blocking software,
  • The ability to play audio files,
  • The ability to play video files.

The buyer cannot make a purchase anonymously or under a pseudonym.

It is forbidden for the Buyer to provide unlawful content, in particular by sending such content to the email address provided in the content.

§ 3. Intellectual property rights

  1. The Seller hereby instructs the Buyer that the course constitutes a work within the meaning of the Act of February 4, 1994. on copyright and related rights, the copyright of which is held by the Seller.
  2. The Seller hereby instructs the Buyer that further distribution of the course by the Buyer, without the Seller’s consent, will constitute an infringement of the Seller’s copyright in the course and may result in civil and/or criminal liability.
  3. The Seller hereby instructs the Buyer that the Buyer is obliged to use only his own account on the Course Platform, and is not allowed to share his access for use with third parties under any title.

§ 4. Placing an Order

  1. To make an Order on the Course Platform it is necessary to properly complete the Order form, accept the provisions of the Terms and Conditions and the cost conditions included in the Order.
  2. The price of the Course quoted at the time of placing the Order by the Customer is binding. The price is the Gross Price.
  3. In case the data provided in the Order is incomplete, the Seller will contact the Buyer. If contact is not possible within 72 hours of the order, the Seller has the right to cancel the Order.
  4. Orders placed through the website can be placed 24 hours a day, 7 days a week, except for technological breaks and maintenance work.
  5. Placing an Order means making an offer to the Seller to purchase the ordered course.
  6. By making a purchase on the site Buyer:
    • confirms the authenticity and accuracy of the data provided during the ordering process
    • agrees to create a user account containing: name and/or unique user login and email address
    • agrees to begin performance of the contract (start of the course) immediately after the payment is credited, before the 14-day deadline.
    • agrees to the provisions of these Regulations, recognizing their binding nature.
    • accepts the information about the loss of the right of withdrawal upon receipt of access to the course.

§ 5. Purchase of a Ticket and/or a Course

  1. In order to purchase a Course, the Buyer must take the following steps:
    • select the course that interests him/her from those available on the Website,
    • Add the product to the cart via the “Proceed to Checkout” or “Buy Now” button and proceed to the
      order summary,fill out the order form, providing the data necessary for the execution of the order and choosing the method of payment. The choice of payment method is limited to the selection of the Payment Provider, as the only form of payment for the course is electronic payment through the selected Payment Provider,
    • accept the Terms and Conditions,
    • Accept the Privacy Policy,
    • accept the information about the loss of the right of withdrawal upon receipt of access to the course.
    • click on the “Order and pay” button
    • After successful payment, the Buyer will be transferred to the Site with confirmation of purchase. At that moment, the contract for the delivery of digital content in the form of a Course is considered to be concluded between the Buyer and the Seller. The buyer will also receive confirmation of the purchase at the e-mail address provided in the order form.
    • The buyer will additionally receive a payment confirmation at the e-mail address provided in the order.

§ 6. Payments

You can pay for your order via the Tpay payment platform (which has the option to pay via Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro, Blik, Instant Transfer and Traditional Transfer).

The online payment service provider is Krajowy Integrator Płatności S.A. The seller informs that in the case of some payment methods, due to their specificity, payment of the order by this method is possible only directly after placing the order.

Buyer by purchasing from the Store accepts the use of electronic invoices by the Seller. The buyer has the right to withdraw his acceptance.

§ 7. Provision and use of the Course

Use of the Course takes place on the website and requires an Internet connection.

The Seller declares that it grants the Buyer a non-exclusive license, entitling the Buyer to use the Course, for a limited period of time (365 days), exclusively for the Buyer’s own use.

The Seller allows the Buyer to:

  • display of course content on the screen of the device used by the Buyer;
  • saving materials other than audiovisual files to the durable memory of the device, printing the contents of text and graphic documents provided in the course.

The seller undertakes to:

  • Provision of the ordered course up to a maximum of 24 working hours from the moment of crediting the funds, with the proviso that the deadline may be extended in exceptional situations such as force majeure, failure of external IT systems.
  • Provide access to the purchased course until access ends, which is 365 days from the date of purchase. After the expiration of this period, the course not completed by the buyer will be forfeited. If the course is not completed within 365 days, it is not possible to extend the deadline.

§ 8. Buyer’s withdrawal from the contract

According to Art. 38 pts. 13 of the Law on Consumer Rights, after receiving access to the ordered course, the student loses the right to withdraw from the contract. By placing an order, the customer simultaneously declares that he/she has acknowledged that he/she has lost the right to withdraw from the contract upon receiving access to the course.

§ 9. Complaints

  • The buyer has the right to file a complaint related to the non-performance or improper performance of services on by email contact available at www.juliafalowska.com.pl
  • Subjective feeling and failure to meet the expectations of the Buyer as to the form, substantive content and usefulness of the course/training are not subject to complaint.
  • The complaint should be sent to the address33-300 Nowy Sącz ul. Jagiellońska 22 in writing with the details of the student/user, e-mail address for correspondence, the name of the course and a description of the case.
  • Complaints will be processed within 14 days from the date of receipt of the complaint.
  • The buyer will receive a reply to the email address.

§ 10.Final provisions

Invoices for the course are issued at the express request of the Buyer. Invoices to the company are issued only if the company’s data along with the taxpayer identification number were provided during the purchase. Invoices are sent to the email address.

These regulations are effective as of 15.01.2024.
